What is a zoning variance?

A variance is a request to build or use a property in a way the zoning code doesn't currently allow on that lot — for example, closer to a property line than the setback rules permit. A variance does not change the property's zoning; the underlying zoning district stays the same.

The Louisville Metro Board of Zoning Adjustment (BOZA) decides variance requests at a public hearing. Planning & Design Services staff review the application first and publish a recommendation before the hearing.

Staff review is followed by a scheduled hearing date. The Board hears the case, staff's recommendation, and any comment already entered into the record, then votes to approve, approve with conditions, or deny.
